The impact of the DMCA’s prohibitions are wide reaching. The DMCA sanctions the use of encryption technologies to “lock down” a creative work to prevent it from being used in ways the author did not intend. As a result, many software developers, computer scientists, and civil liberties groups have complained that the DMCA stifles fair-use rights.
Ultimately, the DMCA’s impact may be to make the first innovators in a field the last. This is because, as Tampa patent attorney and computer game designer Andrew Greeberg has observed, the DMCA protects with patentlike scope, and for an almost indefinite term, unexamined and unpatentable inventions.
