DVD-Cracking Code Not Free Speech
Internet disclosures of trade secrets aren't protected by the Constitution's free-speech guarantee, the California Supreme Court has ruled in a decision hailed by Hollywood and business groups.
The high court's unanimous decision Monday reversed a lower court that had ruled disseminating trade secrets is protected by First Amendment rights.
The case involved coding used to keep consumers from making copies of DVDs. While ruling on the general question of trade secrets, the justices did not resolve Monday whether the DVD code was still a trade secret, leaving that question for a lower court.
San Francisco computer programmer Andrew Bunner had posted the code to circumvent DVD encryption technology in 1999 and, according to the movie industry, helped users freely replicate copyright movies.
